2. WHEN DO WE COLLECT DATA ABOUT YOU?
2.1. Accessing our website / access data
Each time you use our website, we collect the access data that your browser automatically transmits to enable you to visit the website. This access data includes, in particular:
The processing of this access data is necessary to enable visits to the website and to ensure the long-term functionality and security of our systems. The access data is also temporarily stored in internal log files for the purposes described above. The legal basis is Art. 6 (1) (b) GDPR.
The information stored in the log files does not allow any direct conclusions to be drawn about you personally.
2.2. Contact
You have various options for getting in touch with us. These include the contact form, the online form for making appointments, and contacting us by email. In order to be able to provide you with these online forms, we use the HubSpot service. Which data is collected in each case can be seen from the respective input forms. In this context, we process the data exclusively for the purposes of communication and making appointments with you. When communicating with interested parties, the legal basis is our legitimate interest pursuant to Art. 6 (1) (f) GDPR. If data processing is necessary for the implementation of pre-contractual measures or for the fulfillment of a contract, Art. 6 (1) (b) GDPR applies. The data we collect when you use the contact form will be automatically deleted after your request has been fully processed, unless we still require your request to fulfill contractual or legal obligations.
2.3. Newsletter
In our newsletter, we regularly inform you about our products, news, events, and promotions. Our newsletter is sent by our service provider HubSpot.
Personal service is our top priority. We value a personal approach when presenting our products and services. For this, we need your title and your first and last name. Furthermore, we offer the platform and associated services exclusively to businesses. By providing your business email address and company name, we make it clear that you are the right person to contact.
To send our newsletter, which requires registration, we use the so-called double opt-in procedure or single opt-in procedure (country-dependent). This means that we will only send you a newsletter after you have expressly consented to us activating the newsletter service. If a double opt-in is required in your country, you must also confirm that the email address you have provided belongs to you. For this purpose, we will send you a notification email and ask you to confirm that you are the owner of the email address you have provided by clicking on a link contained in this email.
If you confirm your email address, we will store your email address, the time of registration, and the IP address used for registration until you unsubscribe from the newsletter. This storage serves the sole purpose of sending you the newsletter and verifying your registration.
HubSpot integrates a "web beacon" into our newsletter, which sends a notification to HubSpot when you open the newsletter and/or click on a link contained therein. Information about your browser, location, and IP address is transmitted to HubSpot. We use this information for statistical evaluations to understand the effectiveness of our advertising measures and to tailor the newsletter to meet your needs.
Our newsletter provider also uses this data, but only in pseudonymous form (i.e., without allowing your identification), to analyze and optimize its own service. However, your data will never be used to contact you.
The legal basis for processing your data for the purpose of sending the newsletter is your consent in accordance with Art. 6 (1) (a) GDPR. You can revoke your consent at any time with future effect.
You can unsubscribe from the newsletter at any time, for example, using the unsubscribe link at the end of each newsletter. Alternatively, you can also send your unsubscribe request at any time to the contact details listed above. This will incur no costs other than the transmission costs based on your internet service provider's basic rates.
3. WHAT DO WE USE YOUR DATA FOR?
3.1. To fulfill contractual obligations (Art. 6 (1) (b) GDPR)
We use your data with the aim of providing you with the best possible service experience. We handle your data responsibly. We use your data specifically to process your (service) requests.
3.2. Within the framework of the further balancing of interests (Art. 6 (1) (f) GDPR)
We may also use your data based on a balance of interests to protect our legitimate, usually commercial, interests or those of third parties, processing pseudonymized or anonymized data wherever possible. This is done for the following purposes:

If these service providers and Marquardt Group companies process your data outside the European Union, this may result in your data being transferred to a country that does not offer the same data protection standards as the European Union. In this case, we ensure that the respective recipients of your data contractually or otherwise guarantee a level of data protection equivalent to that in the European Union.
5. USE OF COOKIES
To make visiting our website more attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted after the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your device and enable us to recognize your browser the next time you visit (persistent cookies). 6. USE OF GOOGLE ANALYTICS
This website uses Google Analytics, a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses cookies and similar technologies. Cookies are small text files that are stored on your hard drive when you visit our website. Cookies are used to temporarily store information – for example, for statistical evaluations or to control connections while you visit a website. Cookies are also used to store visitor preferences. This allows us to tailor the content of our website to your needs and thus improve our offering for you.
The data collected in this context may be transferred by Google to a server in the USA for evaluation and stored there. If data is transferred to an unsafe third country, this is done on the basis of Art. 49 (1) (a) GDPR. However, your IP address will be shortened before the usage statistics are evaluated, so that no conclusions can be drawn about your identity. For this purpose, Google Analytics has been extended on our website with the code "anonymizeIP" to ensure anonymized recording of IP addresses.

Some of the cookies we use are automatically deleted from your hard drive at the end of your browser session (session cookies). 7. USE OF SOCIAL PLUGINS
We offer you the option of using so-called "social media buttons" on our website. These buttons are integrated into the website only as graphics containing a link to the corresponding website of the button provider. Clicking on the graphic will redirect you to the services of the respective provider. Only then will your data be sent to the respective provider. If you do not click on the graphic, no exchange of information will take place between you and the providers of the social media buttons.

8. USE OF SOCIAL MEDIA FAN PAGES
Marquardt uses social media profiles on the social networks YouTube and LinkedIn. Content and offers are regularly published and shared on these social media pages.
With every interaction on our profiles or other social media websites, the operators of the social networks record your usage behavior using cookies and similar technologies. Operators of social media company pages can view general statistics on the interests and demographic characteristics (such as age, gender, region) of the social media audience. When you use social networks, the nature, scope, and purposes of the processing of data on social networks are primarily determined by the operators of the social networks.
8.1. Responsible party/provider
LinkedIn Ireland Unlimited Company (Ireland/EU – “LinkedIn”) is solely responsible for the processing of personal data when you visit our LinkedIn page.
If you communicate directly with us via our social media page or share personal content with us, Marquardt is responsible for processing your data. We process this data based on our legitimate interest in contacting the individuals who have inquired. The legal basis for this is Art. 6 (1) (f) GDPR. Further data processing may take place based on your consent (Art. 6 (1) (a) GDPR) or to fulfill a legal obligation (Art. 6 (1) (b) GDPR).
An exception to this responsibility applies to the data processing described below for usage analysis (Page Insights); for this, we are jointly responsible with LinkedIn.
8.2. Processing of your data by the operators
Please note that the operators of social networks also process your data when you use our company pages for their own purposes, which are not reflected in this privacy policy. We have no influence on these data processing activities. In this regard, we refer to the privacy policies of the respective social networks:
8.3. What data is collected?
When you visit our social media company page, Marquardt generally collects all messages, content, and other information that you share with us directly there, such as when you post something on a social media page or send us a private message. If you have an account with the respective social network, we may also see your public information, such as your username, information in your public profile, and content you share with a public audience.
8.4. Usage analysis (page insights)
With every interaction with our social media company page, LinkedIn uses cookies and similar technologies to record the usage behavior of page visits. On this basis, the page operators receive so-called "Page Insights." Page Insights contain only statistical, depersonalized (anonymized) information about visitors to the social media page, which therefore cannot be assigned to a specific person. We have no access to the personal data used by LinkedIn to create Page Insights ("Page Insights data"). The selection and processing of Page Insights data is carried out exclusively by LinkedIn.
Page Insights help us gain insights into how our Company Pages are used, the interests of our Company Page visitors, and which topics and content are particularly popular. This allows us to optimize our Company Page activities, for example, by better addressing the interests and usage habits of our audience when planning and selecting our content.
Marquardt and LinkedIn are jointly responsible for processing your data for the provision of Page Insights. For this purpose, we and LinkedIn have entered into an agreement specifying which company fulfills which data protection obligations under the GDPR with regard to the processing of Page Insights data.

8.5. YouTube
We have embedded videos on our website that are stored on YouTube and can be played directly from our websites. YouTube is a multimedia service provided by YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA ("YouTube"), a subsidiary of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). The legal basis is Art. 6 (1) (f) GDPR, based on our legitimate interest in the integration of video and image content.
When you visit our website, YouTube and Google receive the information that you have accessed the corresponding subpage of our website. This happens regardless of whether you are logged in to YouTube or Google or not. YouTube and Google use this data for the purposes of advertising, market research, and tailoring their websites to meet your needs. If you access YouTube on our website while logged in to your YouTube or Google profile, YouTube and Google can also link this event to the respective profiles. If you do not wish this assignment to be made, you must log out of Google before accessing our website.
You can configure your browser to reject cookies, as described above, or you can prevent Google from collecting and processing data generated by cookies and related to your use of this website by deactivating the "Personalized ads on the web" button in the Google advertising settings. In this case, Google will only display non-personalized ads. For more information, see Google's privacy policy, which also applies to YouTube.
9. WHEN DO WE DELETE YOUR DATA?
As a general rule, we only store personal data for as long as necessary to fulfill the contractual or legal obligations for which we collected the data. After that, we delete the data immediately, unless we still need the data until the expiration of the statutory limitation period for evidentiary purposes for civil claims or due to statutory retention periods.

You have the right to request information about our processing of your personal data at any time. When providing this information, we will explain our data processing and provide you with an overview of the data stored about you.
If any data stored by us is incorrect or no longer up to date, you have the right to have this data corrected.
You can also request that your data be deleted. If deletion is exceptionally not possible due to other legal provisions, the data will be blocked so that it is only available for this legal purpose.
You can also restrict the processing of your data, for example if you believe that the data we have stored is incorrect.

Revoking your consent does not affect the legality of the processing carried out on the basis of your consent until the revocation.
To the extent that we process your data based on legitimate interests pursuant to Art. 6 (1) (f) GDPR, you have the right to object to the processing of your data pursuant to Art. 21 GDPR, provided there are reasons for doing so that arise from your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right of objection, which we will implement even without providing reasons.
